Payments
Following delivery of images or any other content agreed to in the corresponding approval email, payment will be due 30 days from receipt of invoice.
Special Requests/Coverage
The client understands and accepts that the photographic coverage will be as the photographer’s professional expertise determines. Special requests are not binding instruction, although every effort is made to comply with the client’s wishes. Any special requests must be made by the client to View2fill in writing and acknowledged.
View2fill utilises a network of regional photographers, on occasions and without notice it may be necessary for the photographer originally specified to be substituted by another photographer, (e.g. due to ill health).
All image sizes are nominal. View2fill will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of varying light conditions, screen type and billboard location. It is sometimes impossible to record on film the exact colour as seen by the human eye.
View2fill provide fully edited images to best meet the brief and client requests. Retouching, digital manipulation and artist finishing is available to the client as an optional extra.
All images and content supplied is done so for the following use: Proof of advertising display Internal and the wider media industry marketing purposes Showcase campaign to end client
Future Media Sales content Social media usage is acceptable, but View2fill should get credited. Images cannot be used without prior consent for end client product or services sales, used in future marketing material such as Online, Press, or TV advertising. Images cannot be repurposed and submitted as additional client photography, i.e. supplied to further clients beyond which was
originally shot, as photography of other campaigns.
Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically/ electronically or by any other means an image created as part of this contract without the permission of View2fill in writing. Any usage of images or content, beyond that which is stated above without written consent will be regarded as a breach of copyright.
Raw images/digital files remain the property of View2fill. View2fill will not supply raw image files or working editing files such as Adobe Photoshop or Illustrator
The photographer/s shall be granted complete artistic licence including in relation to the angles and locations shot from. The photographer/s’ judgement regarding the angle of view and number of images taken shall be final. Due to the vagaries of the weather, physical obstructions and billboard faults it may not be possible to capture all the images requested.
Where photographer/s attend a billboard location and the campaign is not running, or there is a site fault that cannot be rectified, the shoot is still chargeable, unless View2fill is made aware prior to start date. Every effort will be taken to contact the client or content management teams while on site to get the campaign live, but time on site will be limited to 30mins. Minor screen faults can and will be rectified in post production, but major faults may involve a creative overlay. Clients will always be notified in these circumstances.
The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.
View2fill retains the rights to all imagery and can use the images included in this contract for their own marketing purposes.
The client may cancel this contract up to 14 days prior to start date by giving written notice to View2fill. Should cancellation be received by View2fill less than 2 weeks prior to the start date, the client will be billed sum equal to 25% of the contract value.
In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss. Complaints Any complaints should be raised by the client with View2fill, in writing, within 28 days of first becoming aware of the matter to be complained of and in any event within 28 days of receipt of the images.
Approval to proceed with any booking confirmed by email will also act as acceptance and acknowledgement of these terms. In doing so you agree to the following: I have read this booking form and agree to abide by the terms of agreement set out in it. I understand that the terms of this agreement cannot be changed unless agreed by both parties in writing.
